2.1) You are a lawyer for Western National Life Insurance Co. You have been asked to give legal advice on whether Western National Life is legally obligated to pay the $50,000 death benefit on the life insurance policy of Daniel Wilson. Mr. Wilson died from a heroin overdose in January 2003. On the insurance policy application that Mr. Wilson submitted in December 2001, he stated that he had not been treated for alcoholism or drug addiction in the past 10 years. He also stated that he had not consulted or been examined by a physician in the last 5 years. However, it was discovered that on August 13, 2000, Mr. Wilson fainted from a heroin overdose and was treated by an emergency room physician for the overdose. Mr. Wilson then spent three weeks in the hospital’s alcohol and drug treatment center for treatment of heroin addiction. The relevant law in this case is that if there is any misrepresentation or concealment, whether intentional or innocent, then an insurance company is entitled to rescind the life insurance policy.
Based on the above information, is Western National Life legally obligated to pay the death benefit?

A random sample of 500 people out of 5,000 who had contacted customer service in 2008 were asked to respond to the following statement: I was satisfied with the assistance that I received from customer service.
