My fiance and I are going for custody of his 3yr old son. They currently have joint custody w/ primary placement to her since 2007. Recently, the mother and newborn (born March 17th) both tested positive for cocaine. She also admitted to using methadone, hydrocodone, marajuana, heroine and cocaine through out her pregnancy. She has indicated CPS reports against her for unfit living conditions, and the home did not pass a building code inspection. The live in boyfriend has been convicted of rape 1st, holding up a resturaunt in NY, and 3 DUI’s. THe mother also has other indicated cases and charges for DUI, endangering an infant is 2002, and has been listed on CPS cases where crack cocaine were present in the home (not indicated against her). My fiance and I have filed all the custody paper work and have complied with the courts: Submitted negative drug screens. The only other aspect that we have not been able to fulfill is a home study, since the cost is over 00.00. No one in the home in which my fiance’s son resides has a job and her parents and welfare support the mother. We work daily, pay all of our own bills, continue to pay child support (which is 3 weeks ahead), do not do drugs, and are in the process of buying our own home. CPS refuses to answer my fiance’s calls, messages and emails. The case worker has also told the mother about in depth conversations between the father and herself, it is my understanding that all correspondence is to be confidential? Is there any way of getting a case wroker switched? Is there any other avenues we can address to gain custody, or will the home study need to be completed. We have contacted our local social services office, but we live in CT and the mother and child live in NY.

I think that you need to make an appointment with a cilvil court show all the evidence that you have your and your fiance’s paystub in handy get a lawyer and fight for the sake of the poor kids they need a better life and you seem like you and your fiance’s can give that to them I hope this helps !!1
