Question by Twilight: What do you think should happen for this mother and unborn child (see question)?
“CHILD Safety officials should be given the power to protect the eight-month fetus of a drug-addicted Brisbane prostitute, it has been claimed.
The Courier-Mail reported the State Government was searching for the woman but could not legally intervene until the birth of the child.

“The rights and liberty of the mother” prevented any prior intervention, the Department of Child Safety said.

But many Brisbane residents feel the Child Protection Act of 1999 should be changed in extreme cases of prenatal abuse.

“Child Safety should be able to intervene during pregnancy as her drug habit will affect the baby. To just step in after it is born is a bit too late,” one reader wrote.

Another said the Government made the law and was copping out by claiming it “was unable to do anything”.

The law allows the Department of Child Safety to offer counselling to the woman and assess the risk, but not to take any further steps to protect the child.

Children’s Safety Australia president Kim Jackson said she agreed with citizens who wanted legal powers expanded in extreme cases.

“If there is not legislation in place, there seems to be a dire need for it,” Ms Jackson said.

The prostitute, in her 20s and said to be addicted to heroin and speed, has advertised herself to men with a “pregnancy fetish” on an erotic website saying she needs money after being abandoned by her partner.”

I think if a woman makes the decision to carry a child to term then that child’s health and safety should come before the mother’s rights. She should be locked up in a hospital ward until the baby is born and lose all rights to that child unless she gets clean.
