Obviously I am getting an attorney, on Monday, but I am curious to know if anyone has experience that may help me out a bit……

The father of my child is 27 years old and recently got kicked out of his mothers house due to her suspicion of him using drugs….although he said to me he wasnt using heroin….he did however spend 280 out of the 300 he got paid on illegal presciption pills, this is also however the fisrt time in a year he has even recieved money….has not spent one dollar on our 5 month old daughter…..

I did not feel comfortablt leaving my daughter with him…he is homeless, jobless, and taking pills i did tell him he could visit her under my supervision until i felt i could trust him….he chose not to take advantage of that offer

he refuses to sign any medical forms for our daughter, i have been on him everyday about signing them so he is going to get a restraining order on me “so he says” he has lied about filing motions with court against me in the past….

he also has a warrant out for his arrest and is a wanted graffiti artist although they dont know its him behind that graffiti name….

what are the chances of me getting sole legal custody of our daughter?
also can the court issue me tempoary sole physical custody? or visitation granted on the completition of a negative drug test or something?

I will be discussing this with an attorney as well, but maybe someone with experiece can point in the right direction is what questions i should ask my attorney etc…..or if anyone in the legal can give me some confidence in my situation…i am nervous and scared and just want to protect my daughter and be there for her in every way

If you are not on drugs, and you can take care of your baby, I can’t see how a judge would not award you custody. However, it is a good thing you are hiring an attorney as they will be the best source of information regarding your rights. Good luck:)
