This situation takes place in a known high-crime area of your jurisdiction, one that you have patrolled for many years.

You are patrolling today in an unmarked unit, which you parked in a position concealed from the direct observation of the intersection of two streets, specifically the corner known for the sale of drugs. You have a clear view of the intersection and can identify individuals as they stand or walk through this area.

A known subject, (you know that he has been convicted of the sale of controlled substances) is observed loitering adjacent to a street known for street level drug trafficking. A vehicle pulls up and waives to the known subject who approaches the vehicle on the passenger side of the vehicle. The known subject leans into the vehicle through the open passenger window of the car. There is a very short conversation when the known subject reaches into his right front pants pocket and pulls a brown pill bottle and opens the cap. The subject then pours several small objects into the palm of his left hand; the driver of the vehicle motions to the contents of the bottle – now in the known subject’s left palm.

The known subject reaches into his palm and hands something to the driver of the vehicle. The driver in turn hands the known subject several pieces of U.S. Currency. The driver pulls away from the intersection. The known subject takes the U.S. Currency after a quick examination of the bills, places them into his left front pocket.

The description of the vehicle and driver is reported via the radio. You learn that the vehicle is stopped several blocks from the scene.

Meanwhile, you approach the known subject and detain him on the street. Based on what you believe is probable cause, you pat down the subject and find what feels like a pill bottle within the subject’s right front pocket. You remove this, revealing a plain brown pill bottle containing several small pieces of suspected crack cocaine. A field test indicates positive for cocaine.

In the left front pocket, you find something that feels like it could be U.S. Currency, and you remove it from his pocket. The contents of the left front pocket include U.S. Currency in several different denominations.

You place the subject under arrest for sale and possession of a controlled substance. You learn that the driver of the vehicle is also searched and found to be in possession of a suspected controlled substance. The substance is field tested and indicates positive for cocaine. The driver is also placed under arrest for purchasing and possessing a controlled substance.

What would you charge the dealer with? Are there multiple charges to be imposed on the dealer?
