Possible outcome of breaking and entering charge?

Question by realbuffy0530: Possible outcome of breaking and entering charge?
My husband was just charged with breaking and entering – however, the crimes occured while he was a cocaine addict. Since then, he has gotten treatment and has been clean and sober for almost a year. He doesn’t even remember committing the crime – that’s how addicted he was. According to the police, he broke into a gas station twice and stole approximately $ 400 (combined). My question is – what is his possible sentence and will they take into account the fact he was a heavy cocaine user and alcoholic at the time, but is now clean and sober?

If he has no priors they will definitely take it into account. However if he already has a criminal record and they see a pattern, being on drugs at the time will not make a difference.
My brother had a similar situation of breaking and entering, and tried the being high defense but he already had a burglary of a vehicle on his record and received a 10 yr sentence. He pulled 20 months on it.He is out now and on parole.Good luck.
