On probation in one state and took a misdemeanor plea in antoher?
Question by ray m: On probation in one state and took a misdemeanor plea in antoher?
I am a 15 year Army Veteran recently diagnosed with PTSD. I never had any issues with the law until I did my last tour in Iraq. I came back angry and drank all the time. I ended up getting a DUI and battery charge for a bar fight in the last state that I live in. I was given unsupervised probation and they gave me permission to leave the state. I got out of the Army, moved and got a new job but my behaviors didn’t change and I continued to drink and fight. I caught a misdemeanor battery charge in the new state I live in. The DA and my lawyer wanted me to plea but I told them I was already on probation. They didn’t seem to care. The DA even told the judge when I took the plea that I had no criminal past and offered probation. I was astonished? I think they gave me a break because I was diangosed with PTSD and had already gone through alcohol treatment on my own before I went back to court. However, if my probation officer in my current state finds out about the probation in the other state , what can they do? Does the new state have any jurisdiction since I haven’t broken any rules of my probation in that state. If the last state finds out do they not have to give me a hearing to at least let me tell my side of the story. I am by no means innocent and I believe in taking responsibility for your actions, but I also know I am finaly getting my life back on track and finding out what has been part of the issues with my anger and drinking. Please help.
I was on probation for about six months before I picked up the new charge in another state. The orignal length was a year.

One point you did not cover in your question was how long you were on probation before the violation, if a small amount of time elapsed before the second offense you stand a better chance of being violated by the original probation officer, another point is how much time was the original sentence, if you were almost complete then they will probably overlook it, and the chances of them finding out are very small.~
