Let’s say I take a trip to Amsterdam where it is LEGAL to smoke marijuana. So while I’m in a country that allows it, I smoke and then come back to the good ‘ol United States. Then lets say I have a pop drug test or something and fail it. Can I be terminated for “illegal drug use” if I can prove that I was in Amsterdam and that’s when I smoked?

Or does it still not count? Because as I see it, I don’t think you can be fired for doing something that’s legal in another country – while you’re there.

I think it’s the same as going to a country where the drinking age is 18, drinking and then when you come back and having someone give you a Breathalyzer and tellling you, you failed it and are getting a ticket (or something like that). I don’t see how they can charge you with anything.

So anyone know for sure?
Not that I’m planning on it, but just thought it was a curious question after watching Harold & Kumar.

You would still be fired. It’s about the law in the country you live in, not the one you visited.
