We live in Kentucky.
My husband had been on probation (which would have been over, if he had his fines caught up) and he had a couple felony charges prior… It was actually him taking the blame for his ex, because of their kids. (There is proof she was the one busted) -Drug related.

When we met, he changed his phone number, quit doing drugs, etc.
Anyhow, my husband is an idiot. And, His old friends started getting his number… and long story short. He is now in jail for xanax and (Possible) theft. He had taken 95 xanax in one week. And doesn’t remember much at all. I thought he was just very sleepy-because he had been working a lot of overtime (and there’s proof of that).

Let’s give him the benefit of a doubt here. He regrets what he did (because of our family, not because he’s stuck in jail) and truly wants to change.

He wants to go to Drug Court… Because it is harder to pass than rehab. And, it is for people who need (and are willing to get) help.
-My husband KNOWS that He will lose me if he fails, or if I ever so much as suspect him on anything, or with anything.
I’ve done some research.. I’ve read where when xanax are abused they do cause you to do crazy things, and you do tend to forget it.
-There was info from 2004. By that time 1094 people had passed drug court (in an area, can’t remember where) but from 1996, 3000 people had taken drug court.
-From what I understand, if you fail drug court, you just do your time anyway.
-I’ve also read in an article (for Kentucky) that Drug Court saves about 14 million in jail and prison cost.

To be honest, I truly believe this is an eye opener for my husband, his parents have commented on how meaningful he sounds now, and how he never cared before, etc. He knows I will not tolerate it, and our kids and I don’t deserve it. If he were to fail drug court, or something… I would want him in jail. I want him not a day too late, but not out a day too soon, as well. He needs help, he recognizes that.
I also understand the Three Strikes law…. For a persistent felony offender.
-With the PFO, Could the judge dismiss it IF he passes drug court? Or is it like a federal offense type situation.
-Would he POSSIBLY have a lucky chance, at getting ONE more chance by the county?

He’s being (Possibly-not proven) charged with 3 counts of theft. In our area, a lot of people have been arrested for theft, etc. Even after his arrest. So I’m wondering if he was at the wrong place, at the wrong time? I honestly have no idea. But I do know that he wouldn’t do something like that if he were in the right mind. I’m wondering if that will matter.
If he is guilty, he is willing to pay any restitution. And, we talked about apology letters. Not that it makes much of a difference, but if he is guilty, he is sorry. He is not the type of person to hurt someone.
He blames himself for abusing the xanax, he said it’s all his fault, and he is willing to take the fall. The theft however, he couldn’t picture himself stealing, and doesn’t remember much.
He doesn’t remember conversations we had during those couple weeks prior to his arrest.

He wants help, period. But what are his chances of getting drug court, with the theft charges, if he is convicted? The Drug Court program last 18-24 months.
I have been trying to get ahold of his lawyer, but he’s not returning my calls.
Also, I’m wondering about the Persistent Felony Offender. (IF) Granted AND Passed Drug Court, can he avoid the PFO?

Also, there was no weapon involved.

He wants to get his GED. He may be starting on that now, not sure. And, he wants to attend college when he gets out. IF he gets out, he wants the Judge to make it a violation if he doesn’t go to college. (Can/Would the judge do that)
