Does Workman’s Comp apply to us?
Question by Marlee Mouse: Does Workman’s Comp apply to us?
We have a program called Project Rescue it is run by a preacher and his wife. We have a problem going on with a lady claiming she was hurt while moving a TV of ours. I wont go into to many details of course but the lady and her husband were not actually receiving a pay they were living on our premises and helping us out with some of the people in the program (its an alcohol and drug addiction recovery center) the husband of the women who is claiming she was hurt was in our program and had finished the program and moved on to a different part of the program, it is a NONPROFIT organization and NO ONE recieves a salary only we allow them to stay with us and get them back on thir feet, the lady was hurt and didnt go to the hospital until a few days later then she actually filed lawsuit against us THREE months later (she says we have to pay for her hostipal bills and future sergeries because “they cant afford it” and then at the end of the court session they ordered a transcipt and the judge said that it will be $ 100 and they said “that would be no problem” – see the irony- help me out! thanks a bunch!!

Volunteers are generally covered under the workers comp laws if the organization chooses to have them covered. If the organization chooses not to cover them under workers’ compensation the organization is subject to normal liability laws so the organization is MUCH better off if they cover volunteers under work comp.
