In 2003 I was charged with a dui. I received a sentence of diversion. I failed to complete the diversion successfully because I was transferred out of the area for work and could not complete my classes in time. I did however pay the fine in full and complete all other necessary requirements. I since 2009 was picked up on the case (warrant) and posted bail. I hired a lawer and explained since that time I have not had any drug or alchol related offenses and have a clean record. I did try and complete the classes. I went to court and was convicted of dui. I was sentenced to one year license suspension and 4 days jail as well as an evaluation by a mental health therpist that will more than likley ignore the fact that I have been living a sober lifestyle since 2003 and hate drugs and alchol. and have me enter AA. I am beside myself because I feel that classes and anytype of rehab is not applicable. Can’t there be anything I can do? My lawyer also was a joke and did nothing to distinguish the fact that my dui is different because it was 6 tears ago and I since have not had any related charges nor any for that matter. At one point during the trial I was telling her what to say!!!!!! Can I do anything to better my situation? I want to appeal the sentence and have amended to take into account my record.
