Accused of stealing while on narcotics?

Question by Angel Stokes: Accused of stealing while on narcotics?
My husband is a felon (in which, there is a cd that could prove he wasn’t on it, but he took the fall because of his ex… he had a small felony that was about to be dropped, and she did something illegal, of course… and he got the fall for it, because of the kids.. and you cant have 2 felons in the same house or something.. I don’t think this is relevant, just trying to give the most detail right now..

Well he was also on probation (doing great, btw he was already done-just haven’t been able to pay the fines up yet) No body is worried about this right now, and even pointed out that he was almost done..
My husband apparently has been using zanex a lot. And, is abusing them (this must have been the past couple months) I saw him this morning, he looks sorry, he knows what he lost… which doesn’t change, just makes me think..

Anywho… He’s being accused of stealing.. He wouldn’t normally do this, but I’m wondering if the stuff -which was not prescribed- was messing with his mind or something..
I doubt that he could plead “on drugs”… well, I talked to him this morning, I told him I wanted him to go to court and tell him he wanted rehab… he agreed, said he’s been thinking a lot about it. About how he’s been wanting a pill just to make him feel better.. and he wants rehab (we’re talking about a very stubborn guy, who generally denies reality that is of a fault..

Well, this is going to be a long process, they aren’t worried about the drugs, only the theft. He says he doesn’t remember anything really this past couple weeks. He’s always been honest with me, and he agreed that he has abused them dishonestly. Anywho, I’m just trying to clarify, I think he is serious. He started getting involved with the wrong crowd (I think) and Idk what to do.
He does NOT know that he is being questioned for theft. They have NOT talked to him about it. I know this for 100% fact. So, I’m trying to figure out where we stand.
I just want to know… what’s the possibility… It’s up to the judge, I’m sure… But what can he face, any helpful websites (that I would comprehend)? Thanks.

My husband now has a 2nd degree possession (of zanax) and that’s what he think he is in for… The cop told me, that if I cooperate, (about the stolen stuff) it’ll be easier for them to figure out if it’s him or not. They said that they don’t want me to say anything, I guess because they think he will be honest if he doesn’t expect it… (but he doesn’t remember anything)! So, I’m not sure what to do… Thank you for your reply. I guess my question is… His sentencing, I know it’s up to the judge, but I don’t know if it’s going to be a terrible sentencing or what… It’s going to be bad, either way. But I know nothing about this.

I’m posting this here, because I am desperate, and nowhere else have I found any help…

I am also wondering which would be best for him? Rehab or substance abuse program, and I’m wondering some details on those, and how much they generally cost…

Idk if I said this, but he said he was eating crunchbars, like candy…

I am a well versed user of Xanax and other Benzodiazepines, because I have been taking them for my anxiety disorder for a few years.

I can tell you right now that when I was high on Xanax or Klonipin I did some of the most stupid things I have ever done in my life. (committed various felony’s. Things that i would have NEVER done otherwise.) And that’s why i decided to stop taking them.

If you ask me your husband should claim temporary amnesia, due to substance abuse. Maybe its his fault for abusing Xanax, but its Xanax fault for him stealing.
