In April of this year my father got total knee replacement and a week later was transferred to a live in rehab center with 24 hour full medical staff. He is in his mid seventies and 220 pounds heavy. He couldn’t walk or stand on his own at the center but we were seeing some improvement towards the end of the fist week. Then on the 6Th day (Saturday) early morning my father needed to use the restroom and he called the nurse station for help. His leg was elevated and immobilized on exercise machine. After 15 minutes someone (a nurse aid) came in and my dad asked her to release his leg from the machine to use the restroom. (he has very limited English). The nurse aid who’s English was somewhat limited as well shook her hand as an ignoring gesture and left. My dad with great difficulty release his leg and used the wheelchair to get to restroom but fell on his back and broke a rib and had partially collapsed lung. Approximately one hour later 7 o’clock in the morning I got a call from the rehab center that my father fell down and they need me there. My father cried when I arrived there within 20 minutes and he was in great deal of pain and had difficulty breathing. He was dragged across the floor and put in his bed before my arrival. He was not given any painkillers nor ambulance was called. The nurse was just starting to contact the mobile radiology unit to x-ray his knee and this was almost two hours after his fall. I demanded to call an ambulance after his roommate said that “he was surprise they didn’t call the ambulance, the fall was pretty bad”. Their excuse for negligence was ” time for staff shift’. My father spent 4 days in ICU unit at the hospital. Unfortunately as a result of this incidence my father’s recovery was prolonged for months and flexibility and pain of his knee was not any different from before surgery. He stopped his outpatient rehabilitation one month ago (different facility).
My question is that is it immoral or unethical to sue the rehab center for financial gain for all the suffering of my father and for the hardship that was put on the family?

Yes that is known as negligence.
