Question by endpoverty: Is there any angle of attack against a drug chemist in cross-examination?
I’ve witness in a trial for the possession of drugs and the defense counsel was unable to cross-examine the testimonies of the drug chemist, and the expert said that all the 4-tier tests that he ran to on the drugs were error-free and United Nations’ certified. How would you cross-examine the expert then? Any ideas in the forms of questions? Thanks.

A standard in court is established with the training, education, and means of conducting drug or other evidentiary testing is established as credible and reliable.

The only other way I could suggest a cross examination is by determining if any required continued education is maintained; or the lab testing equipment is periodically certified; or the procedures established to conduct the testing were followed.

In a court of law, a good defense lawyer will attack a case from the very beginning. In a case involving evidence, you would want to try to determine if the evidence was obtained through a legally acceptable process…was the search warrant good with probable cause. Was the evidence collected properly. Was the evidence secured properly or was there a break in the chain of custody. Was the evidence stored properly or did it require special storage procedures.

In this day, procedures have been challenged so often that government representatives bringing the case to court normally have those problems ironed out. None the less, a good defense attorney will still challenge procedure!
