A woman drove across a highway median and hit my truck. It was totaled and I am having ongoing back problems now. She has no insurance, property, or even job. I only ended up with bluebook value on my just paid off vehicle and actual out of pocket medical cost due to having an uninsured motorist policy myself. I probably won’t collect for 4 days missed work or pain and suffering since she is on disability / welfare.
On the police report it says that she admitted to the officer that she had taken 3 puffs of cocaine and it caused a panic attack. So, not only did she fail the feild sobrity test for alchohol, she was smoking crack while driving!!!
I would like to prosicute her criminally in such a way as to keep her from getting back her drivers license until she pays me for my time missed at work and pain and suffering.
I have a civil judgement, but as they say you can’t draw blood from a turnip. I just want to keep her off the road as long as possible so no one else suffers.
I would love to persue asault charges. I don’t know if the DA would go for it. I can at least ask. I have been told so many things on this. But nothing from the DA yet.
Anyone know the statute of limitations on filing a criminal suit for this?

The state is the only party who can seek a criminal prosecution. You need to get with the DA and have them throw the book at this loser.
