addiction advice please help!?

I have a younger brother who is 27. He has been addicted to meth amphetamines, aka crank since he was 18 or 19. My family has struggled with this problem for years. He went to go live with my aunt for a few years thinking that he needed to get away from friends close to home but it only got worse. My mom spent 30,000 to send him to a high class sober living treatment center for a year. then he came back home to live back with my mother about 3 months ago. She thought that he was on the right track to sobriety and he could live at home again. Plus she couldn’t afford the expense of the sober living place anymore. He doesn’t have a job, collecting unemployment and is proud of it. he is not looking for a job or doesn’t want to get back to school. he is lazy and spends his money from unemployment on good times. He recently got back to meth and my mom is stress out. he sleeps all day and when she ask him anything, he lashes out. She is fed up and wants to kick him out. what is the best way to throw him out legally, should the police get involved? Should a restraining order be issued, any advice would help
