Question by confused:/: My daughters dad is trying to get custody of my daughter.?
I was 19 years old when i had my daughter who is now 4 months old I am now 20, her “dad” is 19 now adn has never tried to come and see her and wont help out by sending money. so I went and filled out the papers for child support well he got mad and called and said that he’s going to get custody of her. He’s an ex drug addict, he was on meth heroine pills and who knows what else, he was also in jail and on probation. When i was almost 5 months pregnant he left and moved to a different state. He hasn’t even seen my daughter except for in picture messages that i have sent him other than that he hasnt come to see her or even tried. He said im not going to be able to keep my daughter cuz i still live at home with my parents and dont have a job, which i am in the process of looking for one still. I told he was crazy and that the state of montana isn’t going to give him a child with his criminal history and all. My question to you is do you think he even has a chance of taking this to court and getting even partial custody of her?

No I don’t think he has any chance of getting full custody of your daughter, besides all the things that he has done wrong, courts usually almost always take the birth mothers side, and you living with your parents is not a bad thing, that might actually look good since you have older adult influences around you, he might possibly be able to get visitation rights, just make sure to bring up all the things he does/doesn’t do if you guys go to court.
