ok so i am a first time offender in IL for possession of weed, 2.5 grams so i got a class c misdeminor and 2 yrs supervison 75 community service hours and outpatient rehab and drug test etc, till oct 2010, ive ben in it since oct 08 so it been 5 months so far on it. it was during teh summer etc. my question is ok so i hate supervision and this stupid court shit, its so much for my first offence, ok so can i just go back to court and take jail time which i think is up to 30 days in IL for a class c misdeminor, and if i did this i would go to jail and get out wt nothing but it on my record, no supevision anymore etc. so i can smoke etc. can i do this? i herd from many people that i can just take the jail time. and get off?

When you were originally sentenced, the Judge gave you a definite sentence which he then added he will suspend in place of your probationary term. If you decide to serve your sentence instead of staying on probation, you would serve the amount of time that you were originally sentenced to in court. There is no “30 days” and I am free. It is whatever the Judge said, which varies in each case. If you do not recall your original sentence, you can contact your lawyer, the Clerk of Courts or ask your probation officer. They all will have access to the answer.

PS…I just want to add that if you think this court supervision is rough as a first time offender, just wait till you get caught on a second offense. By all means, if you feel a compelling need to get stoned, do so. I am not judging anyone nor would I, but as a person is found guilty for subsequent charges, the restrictions and jail time REALLY gets tight.
