Question by Mother of boys: will he get jail time or rehab?
he’s in jail awaiting his court date. He was on probation(community control) and got caught with cocaine. I called his probation officer and asked what was going on. He said he put in a recommendation that instead of serving time in jail that he go to an inpatient rehab facility. He also said that just because he reccomends that, the judge may or may not follow it. Depends on the judge and his mood. Does anyone have experience with this….do judges usually follow the reccomendations of probation officers?

Not always the probation officer is right. If U have a lot of priors or he has dealt with numerous cocaine possessions all day he may not go with rehab. But on the other hand he may be in a good mood & follow the recommendation of probation officer. What does the prosecuter think why isn’t lawyer running his recommendation by him/her. to plead guilty with an offer of rehab. Usually if prosecuter agrees to recommendations the judge will.
