Question by Jean: What are the grounds for terminating parental rights in the state of California?
I am a mother seeking to terminate the rights of the father of my 2 year old. He was convicted of 1 Felony & 3 Misdemeanors and incarcerated when she was 11 months old. One of the Misdemeanors was from abuse he inflicted upon me and then when I told him it was over and was going to file for a divorce he choked me until I passed out resulting in the Felony and Misdemeanor for breaking the restraining order. The other Misdemeanor was from breaking the order again by contacting me from jail. He recently got out of jail and last month entered a rehab center to deal with his drug abuse issues which is a 12 month program. He would have been in jail for longer but he pled guilty at the last minute…He has a long criminal history and he has never been able to stay off drugs for very long. In the year since he has been gone I have created a wonderful life for myself and my daughter. She is the happiest little girl and I want to keep her that way. I want to keep her safe.

Your ‘re going to have to The Friend of the Court and probably several courts appearances, but with his record it doesn’t seem like you should have any trouble getting full custody of your daughter. We just went through a similar situation, I know how you feel and how you want the best for her and her safety. But through the courts is the only way I know. I wish you the Best of Luck. We lucked out the father of my grandson , as bad as its sounds OD, now hes gone for good.
